Terms and Conditions

1. About These Terms

These Terms and Conditions govern your use of this website and any purchase made through it. We may update these Terms from time to time; the version in force at the time you place an order will apply to that order. Continued use of the site after changes are posted means you accept the updated Terms.

2. Products and Availability

We sell beekeeping equipment, hives and hive components, protective gear, extraction equipment, and live bees, nucs and queens. We try to keep product descriptions, images, pricing and stock levels accurate, but errors can occur and stock is not guaranteed until your order is confirmed. If an item you have ordered is unavailable or incorrectly priced, we will contact you to offer a substitute, a refund, or the option to wait, before proceeding.

3. Orders and Payment

By placing an order you are making an offer to purchase, which we may accept or decline (for example, where stock is unavailable or a pricing error has occurred). Prices are shown in Australian dollars and include GST where applicable. Payment is processed securely at checkout; we do not store your full credit or debit card details, which are handled by our payment processor. Order confirmation emails acknowledge receipt of your order and do not guarantee availability.

4. Shipping and Local Pickup

We ship Australia-wide using Australia Post and offer local pickup from our Thomastown premises. Shipping costs are calculated at checkout based on your delivery address and the weight and dimensions of your order. Delivery timeframes shown at checkout are estimates only; we are not responsible for delays caused by the carrier, weather, or other events outside our control.

5. Live Bees, Nucs and Queens

Live bees, nucleus colonies (nucs) and queen bees are living animals and are treated differently to other products:

• Delivery of live bees is subject to weather, transport conditions, and carrier acceptance, and dispatch dates may be rescheduled at our discretion for the welfare of the bees.
• You must be available to collect or receive live bees promptly on the agreed date, and provide a suitable, prepared hive or holding location in advance.
• You are responsible for holding any registrations, permits or approvals required by your state or territory biosecurity authority to keep bees, and for complying with local notifiable pest and disease reporting obligations.
• Because live bees cannot be returned once dispatched, our standard change-of-mind returns (see clause 7) do not apply to live bees, nucs or queens. Where bees arrive deceased or in obviously poor health due to transport, contact us within 24 hours of delivery with photos so we can assess the claim.

6. Your Consumer Guarantees

Nothing in these Terms limits your rights under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded, including that they are of acceptable quality and fit for the purpose for which they are commonly supplied. You are entitled to a replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

7. Returns and Refunds

In addition to your rights under the Australian Consumer Law, we are happy to accept returns of unused, unopened items in original condition within 14 days of delivery, at your cost, for a refund or exchange, except where noted otherwise (see clause 5 for live bees, and note that protective gear must be unworn with hygiene labelling intact). To arrange a return, contact us first using the details in clause 11 so we can advise the best way to send items back.

8. Website Use and Intellectual Property

All content on this website, including text, images, logos and product descriptions, is owned by or licensed to ABS and may not be copied, reproduced or used for commercial purposes without our written permission. You agree not to misuse this website, including by attempting to interfere with its operation, security, or the experience of other users.

9. Liability

To the extent permitted by law, ABS is not liable for any indirect or consequential loss arising from your use of this website or your purchase, except where that liability cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or other applicable law.

10. Governing Law

These Terms are governed by the laws of Victoria, Australia, and any dispute relating to them is subject to the exclusive jurisdiction of the courts of Victoria.
